Terms of Service
These Terms of Service ("Terms") govern your use of the TBNamed mobile application ("App") operated by Chief Automation Experts LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the App.
1. Eligibility
You must be at least 16 years of age to create an account and use TBNamed. By using the App, you represent and warrant that you meet this age requirement.
2. Account Registration
2.1 Account Creation
To use TBNamed, you must create an account using a valid email address and password, or by signing in through Apple or Google. You agree to provide accurate information and to keep your login credentials secure.
2.2 One Account Per Person
Each individual may maintain only one active account. You are responsible for all activity that occurs under your account.
2.3 Partner Linking
TBNamed allows you to link your account with one partner to share name preferences and matches. You are responsible for sharing your invite code only with your intended partner. Each invite code is valid for a single use.
3. Purchases and Payment
3.1 Paid Download
TBNamed is available as a paid download through the Apple App Store and Google Play Store. The purchase price covers access on your device and the ability to invite one partner.
3.2 Refunds
All purchases are processed by Apple or Google. Refund requests are subject to the respective store's refund policies:
3.3 Account Deletion and Repurchase
If you delete your account, all data is permanently removed. Access through your original purchase is also revoked. A new purchase would be required to create a new account.
4. Acceptable Use
You agree to use TBNamed only for its intended purpose: helping you and your partner choose a baby name. You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to other users' accounts or data
- Reverse engineer, decompile, or disassemble the App
- Use automated tools (bots, scrapers) to access the App
- Upload or transmit harmful content, including malware
- Impersonate another person or entity
- Use the App to harass, abuse, or harm another person
- Attempt to circumvent the partner-linking limit to share access with unauthorized users
5. User-Generated Content
5.1 Custom Names and Comments
You may create custom name cards and add comments to names within the App. You retain ownership of any content you create, but you grant us a limited, non-exclusive license to store and display that content within the App for the purpose of providing the service to you and your linked partner.
5.2 Content Standards
You are solely responsible for any custom names or comments you add. While we do not actively monitor user content, we reserve the right to remove content that violates these Terms.
5.3 No Public Sharing
Custom names and comments are private to your account and your linked partner. We do not publicly display, share, or distribute user-generated content.
6. Name Database
6.1 Data Accuracy
The name database provided in the App is compiled from publicly available U.S. records and statistical data. While we strive for accuracy, we make no warranties that the data (including popularity statistics, year ranges, or metadata) is complete, current, or error-free.
6.2 No Professional Advice
TBNamed is an entertainment and decision-support tool. Nothing in the App constitutes legal, medical, or professional advice. The decision of what to name your child is solely yours.
7. Intellectual Property
7.1 Our Property
The App, including its design, code, graphics, interface, and the compiled name database, is owned by Chief Automation Experts LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.
7.2 Trademarks
"TBNamed," the TBNamed logo, and related marks are trademarks of Chief Automation Experts LLC. You may not use these marks without our prior written consent.
8. Privacy
Your use of the App is also governed by our Privacy Policy, available at tbnamed.com/privacy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHIEF AUTOMATION EXPERTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO DOWNLOAD THE APP.
11. Indemnification
You agree to indemnify, defend, and hold harmless Chief Automation Experts LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
12.1 By You
You may stop using the App and delete your account at any time through the Settings screen. Upon deletion, all your data is permanently and immediately removed.
12.2 By Us
We reserve the right to suspend or terminate your account if you violate these Terms. We will make reasonable efforts to notify you before taking such action, except where immediate action is necessary to protect the App or other users.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the App or via email and update the "Last Updated" date at the top. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State in which Chief Automation Experts LLC is incorporated, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Chief Automation Experts LLC regarding the use of the App and supersede any prior agreements.
